IMPORTANT NOTICE

These Terms of Service govern your access to and use of LKHomeBuilder.com and your electronic interactions with LK Homes LLC.

These Terms do not constitute a construction contract and do not obligate LK Homes LLC to perform construction, design, engineering, permitting, estimating, consulting, or other project services.

Any actual project will require a separate written proposal, service agreement, design agreement, construction contract, change order, purchase order, or other written agreement signed by the applicable parties.

Sections 16, 17, 18, 19, and 20 contain important limitations of liability, indemnification obligations, warranty disclaimers, dispute-resolution terms, and governing-law provisions. Please read them carefully.

1. Agreement to These Terms

These Terms of Service, referred to as the “Terms,” are a binding agreement between you and LK Homes LLC, referred to as “LK Homes,” “we,” “us,” or “our.”

By accessing or using LKHomeBuilder.com, submitting a contact form, requesting an estimate, uploading project information, communicating with us electronically, or otherwise using our website or online services, you agree to these Terms and our Privacy Policy.

You represent that:

You are at least 18 years old;

You have the legal capacity to agree to these Terms;

The information you provide is accurate and complete; and

If you act for a business, trust, property owner, partnership, company, association, or other organization, you have authority to act on its behalf.

If you do not agree to these Terms, do not use the website or submit information through it.

LK Homes LLC is a Florida construction company offering or coordinating services that may include:

Custom-home construction

ICF construction

Steel construction

Barndominiums

Garages, shops, hangars, and accessory structures

Commercial or agricultural structures

Site and project feasibility assistance

The exact services offered for any project depend on factors including location, licensing requirements, project type, availability, budget, site conditions, permitting requirements, insurance requirements, subcontractor availability, and a separately executed written agreement.

3. Website Information Only

The information on LKHomeBuilder.com is provided for general informational, educational, and marketing purposes.

Website content is not:

A construction contract

A binding estimate

A guaranteed price

A professional engineering opinion

An architectural certification

A zoning determination

A building-code determination

A permit approval

A property appraisal

Construction requirements vary by property, jurisdiction, building type, code cycle, design, engineering, soil conditions, flood designation, utility availability, access, material selection, and other circumstances.

You should not purchase property, secure financing, order materials, demolish improvements, begin construction, or make another significant decision solely in reliance on general website content.

4. No Construction Agreement Created Through Website Use

Accessing the website, submitting a form, requesting an estimate, speaking with a representative, or receiving preliminary information does not create:

A contractor-client relationship

A design-professional relationship

A fiduciary relationship

An exclusive relationship

A duty to perform work

A guaranteed construction schedule

A guaranteed project price

A commitment to accept your project

A reservation on our construction schedule

LK Homes is not obligated to accept, estimate, design, permit, manage, or construct any project unless LK Homes signs a separate written agreement expressly covering that work.

No employee, salesperson, estimator, representative, subcontractor, or referral partner may bind LK Homes to a project except through a written agreement signed by an authorized representative of LK Homes.

5. Estimates, Budgets, and Pricing

5.1 Preliminary Information

Any price, allowance, square-foot cost, budget range, starting price, payment example, timeline, or cost estimate displayed on the website or discussed before a written contract is preliminary and nonbinding unless expressly stated otherwise in a signed written agreement.

Preliminary pricing may be based on assumptions concerning:

Building size and design

Site accessibility

Soil and drainage conditions

Flood-zone requirements

Zoning and land-use requirements

Utility availability

Well and septic requirements

Material pricing

Labor availability

Building-code requirements

Permit and impact fees

Engineering requirements

Owner selections

Market conditions

Financing conditions

Subcontractor and supplier pricing

Actual project costs may differ materially.

5.2 Starting Prices

The phrases “starting at,” “as low as,” “from,” and similar terms indicate an illustrative base price or preliminary pricing level. They do not represent the final cost of every project.

Unless expressly stated otherwise, displayed prices may exclude:

Geotechnical testing

Clearing and grading

Fill or unsuitable-soil remediation

Driveways

Utility extensions

Wells and septic systems

Impact fees

Permit fees

Architectural services

Engineering services

Unforeseen site conditions

5.3 Expiration of Estimates

Material, labor, transportation, insurance, subcontractor, and supplier costs may change without notice.

Unless a written proposal states otherwise, preliminary estimates and quoted prices may be revised or withdrawn before contract execution.

A price is not locked until the conditions stated in the applicable signed agreement have been satisfied.

6. Project Feasibility and Due Diligence

Any preliminary discussion of zoning, setbacks, flood zones, utilities, site access, buildability, permitting, property records, or development potential is based on the information available at the time.

Preliminary feasibility information is not a guarantee that:

A government agency will approve a project;

A permit will be issued;

A variance or rezoning will be granted;

A particular structure is legally permissible;

Utilities are available or adequately sized;

A property is free from liens, easements, restrictions, wetlands, contamination, or title defects;

Soil conditions are suitable for construction;

A lender will finance the project; or

The final project will meet a stated budget.

Government records and third-party databases may be incomplete, outdated, or inaccurate.

Unless a separate written agreement states otherwise, the property owner remains responsible for obtaining appropriate legal, title, survey, environmental, engineering, architectural, zoning, financing, insurance, and other professional advice.

7. Plans, Drawings, Renderings, and Concepts

7.1 Conceptual Nature

Floor plans, elevations, sketches, renderings, visualizations, mood boards, photographs, videos, models, and example projects displayed on the website may be conceptual, illustrative, modified, digitally created, or based on prior projects.

They may not represent a structure that can be constructed exactly as shown.

Final construction requires appropriate plans, specifications, engineering, code review, permitting, selections, and a signed construction agreement.

7.2 No Guarantee of Exact Appearance

Colors, textures, proportions, landscaping, furnishings, lighting, materials, and surrounding conditions may appear differently in renderings, photographs, screens, printed materials, and completed construction.

Rendered or conceptual images do not guarantee an exact finished result.

7.3 Plans Supplied by You

When you submit plans, drawings, photographs, surveys, designs, specifications, logos, or other materials, you represent and warrant that:

You own the materials or have permission to use them;

You have authority to provide them to LK Homes;

Our review and use of them will not violate another person’s rights; and

The materials are accurate to the best of your knowledge.

LK Homes is not responsible for copyright, licensing, engineering, code, or ownership defects in materials supplied by you or a third party.

7.4 Intellectual Property

Unless a separate written agreement provides otherwise, LK Homes and its licensors retain ownership of website content, original marketing materials, photographs, written content, graphics, logos, layouts, preliminary concepts, and other proprietary materials.

Payment for construction or consulting services does not automatically transfer ownership of architectural plans, engineering documents, stock plans, proprietary details, or licensed materials.

Rights in project-specific plans and deliverables will be governed by the applicable written agreement and the rights of the architect, engineer, designer, photographer, software provider, or other creator.

8. User Submissions

You may submit information through forms, email, text messages, file uploads, social media, or other communication channels.

You grant LK Homes a nonexclusive, limited license to access, copy, store, review, transmit, and use submitted materials as reasonably necessary to:

Respond to your request;

Evaluate a potential project;

Prepare an estimate or proposal;

Coordinate with authorized professionals, subcontractors, suppliers, or consultants;

Maintain business and project records; and

Perform obligations under a later written agreement.

You remain responsible for the accuracy, legality, and completeness of submitted information.

Do not upload malicious software, unlawful material, confidential information belonging to another party, or material you are not authorized to disclose.

9. Telephone, Email, and Text Communications

By providing your contact information, you authorize LK Homes to contact you regarding:

Your inquiry

Estimate requests

Consultations

Appointments

Project qualification

Proposals

Scheduling

Project updates

Documents

Payments

Warranty requests

Customer service

Related construction services

Communications may occur by telephone, email, or text message.

Where you separately consent to marketing communications, messages may also include promotional content. Consent to receive marketing messages is not a condition of purchasing services.

Message frequency may vary. Message and data rates may apply.

Reply STOP to opt out of marketing text messages. Reply HELP for assistance.

An opt-out from marketing messages does not prevent necessary transactional or service-related communications concerning an active inquiry, appointment, proposal, agreement, project, payment, warranty issue, or legal notice.

Mobile telephone numbers and text-message opt-in information will not be sold or shared with unaffiliated third parties for their own marketing purposes.

Your dealings with third parties are governed by your agreements with those parties.

11. Financing

Any financing information presented on the website is general information only.

LK Homes does not guarantee:

Loan approval

Interest rates

Loan terms

Appraised value

Draw schedules

Closing dates

Eligibility for a particular lending program

The sufficiency of financing to complete a project

Unless otherwise disclosed in writing, lenders and financing companies are independent businesses.

You are responsible for reviewing financing documents and obtaining financial, legal, and tax advice before entering a loan or financing agreement.

Construction obligations are not contingent on financing unless a signed construction agreement expressly provides otherwise.

12. Acceptable Use

You agree not to:

Use the website for an unlawful or fraudulent purpose;

Submit false ownership, identity, financial, or project information;

Impersonate another person or organization;

Upload malware, harmful code, or disruptive files;

Attempt unauthorized access to the website or connected systems;

“LK Homes,” applicable logos, and related branding may not be used without written authorization.

You may view and print limited website content for personal, noncommercial evaluation of LK Homes’ services. You may not reproduce, modify, publish, distribute, sell, license, create derivative works from, or commercially exploit website content without written permission.

16. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

LK HOMES DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES RELATING TO THE WEBSITE, INCLUDING WARRANTIES OF:

MERCHANTABILITY;

FITNESS FOR A PARTICULAR PURPOSE;

NON-INFRINGEMENT;

ACCURACY;

COMPLETENESS;

SECURITY;

AVAILABILITY; AND

UNINTERRUPTED OR ERROR-FREE OPERATION.

LK HOMES DOES NOT WARRANT OR GUARANTEE:

THAT A PROJECT WILL BE ACCEPTED;

THAT A PROPERTY IS BUILDABLE;

THAT A PERMIT WILL BE APPROVED;

THAT A PROJECT WILL MEET A PARTICULAR BUDGET;

THAT A PROJECT WILL BE COMPLETED BY A PARTICULAR DATE;

THAT MATERIAL PRICES WILL REMAIN CONSTANT;

THAT FINANCING WILL BE APPROVED;

THAT A PARTICULAR DESIGN CAN BE BUILT AS SHOWN;

THAT WEBSITE INFORMATION IS SUITABLE FOR YOUR PARTICULAR PROPERTY; OR

THAT WEBSITE USE WILL PRODUCE A PARTICULAR BUSINESS, INVESTMENT, OR FINANCIAL RESULT.

WARRANTIES APPLICABLE TO ACTUAL CONSTRUCTION WORK, IF ANY, WILL BE STATED IN THE APPLICABLE WRITTEN CONSTRUCTION AGREEMENT.

17. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LK HOMES LLC AND ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, REPRESENTATIVES, CONSULTANTS, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

WEBSITE USE;

INABILITY TO USE THE WEBSITE;

RELIANCE ON WEBSITE INFORMATION;

A WEBSITE INTERRUPTION;

A THIRD-PARTY WEBSITE OR SERVICE;

AN INACCURATE PRELIMINARY ESTIMATE;

A DECISION TO PURCHASE, SELL, FINANCE, IMPROVE, OR DEVELOP PROPERTY;

LOSS OF DATA;

LOSS OF PROFITS;

LOSS OF BUSINESS OPPORTUNITY;

DELAY;

REPUTATIONAL HARM; OR

UNAUTHORIZED ACCESS OUTSIDE OUR REASONABLE CONTROL.

For claims arising solely from use of the website and not from a separately signed construction or service agreement, LK Homes’ total cumulative liability will not exceed the greater of:

The amount you paid directly to LK Homes specifically for the online service giving rise to the claim during the three months preceding the event; or

One hundred dollars.

This limitation does not apply where liability cannot lawfully be excluded or limited.

Claims relating to actual construction, design coordination, consulting, payments, warranties, defects, delays, or project performance will be governed by the applicable signed agreement and controlling law.

18. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless LK Homes LLC and its members, managers, officers, employees, representatives, contractors, affiliates, licensors, and service providers from claims, losses, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from or relating to:

Your misuse of the website;

Information or materials you submit;

Your violation of these Terms;

Your violation of applicable law;

Your infringement of another party’s rights;

False or misleading information you provide;

Materials you provide without proper authorization; or

Actions taken by LK Homes in reasonable reliance on information supplied by you.

This provision does not require you to indemnify LK Homes for liability caused solely by LK Homes’ own conduct where such indemnification is prohibited by law.

19. Dispute Resolution

19.1 Informal Resolution

Before filing a lawsuit or initiating arbitration arising solely from use of the website, the complaining party must provide written notice describing:

The nature of the dispute;

The relevant facts;

The requested resolution; and

The party’s contact information.

The parties will attempt in good faith to resolve the dispute informally for at least 30 days after receipt of the notice.

This requirement does not prevent either party from seeking emergency or temporary injunctive relief when reasonably necessary.

19.2 Binding Individual Arbitration

Except for:

A qualifying small-claims matter;

A claim seeking temporary or injunctive relief relating to intellectual-property rights, unauthorized access, misuse, or security; or

A claim that applicable law does not permit to be arbitrated,

any dispute arising solely from access to or use of LKHomeBuilder.com or these Terms will be resolved through final and binding individual arbitration.

Arbitration will be administered by the American Arbitration Association under the rules applicable to the dispute.

Unless the parties agree otherwise, arbitration may occur remotely or in Marion County, Florida.

The arbitrator may award any relief available under applicable law but may not consolidate claims or preside over a class or representative proceeding.

19.3 Jury-Trial and Class-Action Waiver

TO THE EXTENT PERMITTED BY LAW, YOU AND LK HOMES EACH WAIVE THE RIGHT TO A JURY TRIAL FOR A DISPUTE SUBJECT TO ARBITRATION.

DISPUTES MUST BE BROUGHT INDIVIDUALLY. NEITHER PARTY MAY PARTICIPATE AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN A CLASS, COLLECTIVE, CONSOLIDATED, MASS, OR REPRESENTATIVE ACTION COVERED BY THIS PROVISION.

19.4 Arbitration Opt-Out

You may opt out of the arbitration and class-action-waiver provisions in this Section by sending written notice within 30 days after first accepting these Terms.

The notice must:

State your full name;

Identify the email address or telephone number used in your interaction with LK Homes;

State that you are opting out of the website Terms arbitration provision; and

Be sent to the contact address in Section 27.

Opting out of this website arbitration provision does not opt you out of a separate arbitration agreement contained in a later construction contract, design agreement, consulting agreement, or other signed agreement.

19.5 Separate Project Agreements Control

This Section applies only to disputes arising from the website or these Terms.

Any dispute arising from an actual estimate, deposit, design service, construction project, subcontract, purchase order, warranty, lien, payment obligation, or project agreement will be governed by the dispute-resolution provisions in the applicable separately signed agreement.

If there is a conflict, the signed project agreement controls.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Subject to Section 19 and any applicable signed project agreement, a legal action arising solely from these Terms or use of the website must be brought in a court of competent jurisdiction located in Marion County, Florida, or in the applicable federal court serving Marion County.

You and LK Homes consent to personal jurisdiction and venue in those courts.

21. Force Majeure

LK Homes is not responsible for delay, interruption, inaccuracy, or failure caused by events beyond its reasonable control, including:

Severe weather

Hurricanes

Flooding

Fire

Natural disasters

War

Terrorism

Civil unrest

Epidemics or pandemics

Labor disputes

Governmental orders

Code or regulatory changes

Utility failures

Internet or telecommunications failures

Cyberattacks

Software outages

Hosting-provider failures

Supplier failures

Transportation disruptions

Material shortages

Acts or omissions of third-party platforms

This section relates to the website. Force-majeure obligations for an actual project will be governed by the applicable signed agreement.

22. Changes to These Terms

We may revise these Terms when our website, services, business practices, or legal obligations change.

The “Last Updated” date identifies the latest version.

Updated Terms become effective when posted unless a different effective date is stated. Material changes may also be communicated by email, website notice, or another reasonable method where required by law.

Changes will not retroactively alter a separately signed construction or service agreement.

Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms.

23. Termination or Restriction of Access

We may restrict, suspend, or terminate access to the website when we reasonably believe:

These Terms have been violated;

Website security is threatened;

Fraudulent or abusive activity has occurred;

Continued access may harm LK Homes or another party; or

Restriction is required by law.

Sections intended by their nature to survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability limitations, indemnification, dispute resolution, and governing law.

24. Severability

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted.

The remaining provisions will remain in full force and effect.

25. No Waiver

A failure or delay by LK Homes in enforcing a provision does not waive that provision or any other right.

A waiver must be in writing and signed by an authorized representative of LK Homes.

26. Entire Agreement and Order of Precedence

These Terms and the Privacy Policy constitute the entire agreement concerning general use of LKHomeBuilder.com.

They do not replace a separately signed:

Estimate

Proposal

Design agreement

Consulting agreement

Preconstruction agreement

Construction contract

Change order

Warranty

Purchase order

Financing agreement

Subcontract

Other project-specific agreement

If these Terms conflict with a separately signed agreement, the separately signed agreement controls with respect to the subject matter of that agreement.

Statements made in advertisements, social-media posts, informal messages, phone calls, preliminary discussions, or website content do not modify a signed agreement.
